1. INTRODUCTION

(Ghar Aarogyam Program) ("app", "we", "us" or "our") is a healthcare-focused digital platform owned, operated and managed by Sewarth Healthcare Pvt. Ltd. ("SEWARTH"). Ghar Aarogyam Program may facilitate healthcare consultations, counselling, clinical guidance, tele-health services, healthcare navigation, wellness support, referrals, educational information and other related digital services through appropriately qualified healthcare professionals engaged or employed by Sewarth.

This privacy policy explains how sewarth collects, uses, processes, stores, shares and protects personal information and healthcare-related information when you access or use the Ghar Aarogyam Program app and related services. It also explains the choices and rights available to you in relation to your personal information.

2. INFORMATION WE COLLECT

Depending upon the services or features you use, Ghar Aarogyam Program may collect information voluntarily provided by you and information generated through your use of the app. This may include your name, age, date of birth, gender, mobile number, email address, address and profile photograph, where applicable.

Where you use healthcare, counselling or tele-health services, Ghar Aarogyam Program may collect and process health and medical information, including medical history, symptoms, diagnoses, medications, allergies, prescriptions, diagnostic reports, photographs or documents submitted for consultation, psychological or counselling-related information, consultation notes and other information reasonably required by the relevant healthcare professional. The uploaded Ghar Aarogyam Program documentation specifically contemplates the processing of medical history, symptoms, consultation records, prescriptions, diagnostic reports, photographs and communications for healthcare-related services.

Where provided by you, we may also collect emergency contact information, including the name and contact details of a person who may be contacted where reasonably necessary for patient safety or emergency escalation.

We may collect subscription and transaction-related information required to administer paid services. Payment processing may be carried out through authorised third-party payment service providers, and Ghar Aarogyam Program does not intend to store complete payment-card information unless specifically required and lawfully permitted.

We may also collect limited technical and usage information, such as your device type, operating system, application version, IP address, login or authentication information, technical logs, crash information and information relating to the security and functioning of the app.

3. COMMUNICATIONS AND CONSULTATIONS

Ghar Aarogyam Program may facilitate communication between you and healthcare professionals through text, chat, audio, video, electronic documents, photographs or other permitted digital communication methods. Depending upon the service used, information exchanged during such communications may be stored as part of the relevant service or healthcare record.

Audio or video consultations will be recorded only where recording is intended and the applicable consent has been obtained, or where otherwise permitted by applicable law. The Ghar Aarogyam Program consent document separately provides for consent to recording rather than treating general acceptance as automatic consent to recording.

Where Ghar Aarogyam Program uses third-party communication channels, including WhatsApp or similar platforms, certain service-related communications may be transmitted through those platforms. Such third-party platforms may process information in accordance with their own applicable terms and privacy practices.

4. HOW WE USE YOUR INFORMATION

Sewarth uses information collected through Ghar Aarogyam Program primarily to provide and administer the services requested by you. This may include facilitating healthcare consultations, counselling and tele-health services, enabling relevant healthcare professionals to review information necessary for providing care, maintaining healthcare and consultation records, facilitating referrals and clinical escalation, managing appointments and subscriptions, communicating service-related information, maintaining account security and operating and improving the app.

Information may also be processed where reasonably necessary to comply with applicable legal, regulatory or professional requirements, respond to lawful requests, investigate security or technical incidents, protect the safety of users and others, or establish, exercise or defend legal rights.

We do not sell or rent your personal or health information for advertising purposes.

5. HEALTHCARE PROFESSIONALS

Depending upon the service selected by you, your relevant information may be accessed by doctors, registered medical practitioners, clinical psychologists, counsellors, therapists, telehealth personnel or other appropriately qualified healthcare professionals engaged or employed by Sewarth. Such information will be made available to the extent reasonably necessary for providing the relevant healthcare service and in accordance with applicable law and professional obligations.

Clinical assessment, diagnosis, treatment recommendations, prescriptions, referrals and therapeutic decisions remain within the professional responsibility and lawful scope of the relevant healthcare professional. The Ghar Aarogyam Program documentation expressly provides that sewarth may directly employ or engage such healthcare professionals.

6. SHARING AND DISCLOSURE OF INFORMATION

Sewarth does not sell, rent or trade your personal or health information. Information may, however, be shared or made accessible where reasonably necessary to provide Ghar Aarogyam Program services or fulfil the purposes described in this privacy policy.

This may include sharing information with healthcare professionals, authorised technology and cloud-service providers, communication and CRM service providers, payment processors, it and security providers and other service providers who support the operation of Ghar Aarogyam Program. Such providers may process information only for authorised purposes and subject to appropriate contractual, confidentiality and security obligations.

Information may also be disclosed where reasonably necessary to address a serious and immediate risk to life, health or safety, including, where appropriate, to an emergency contact, healthcare facility, emergency service or law-enforcement authority, subject to applicable law. The Ghar Aarogyam Program documentation specifically contemplates safety-related disclosure where a serious and immediate concern arises.

Information may further be disclosed where required or permitted by applicable law, court order, regulatory requirement, lawful governmental direction, professional obligation or for the protection of the rights, safety or security of sewarth, users or others.

7. DATA SECURITY

Sewarth takes reasonable technical, organisational and administrative measures designed to protect personal and healthcare information against unauthorised access, disclosure, alteration, loss or misuse. These measures may include access controls, authentication, confidentiality obligations, secure transmission and appropriate security monitoring.

While reasonable safeguards are implemented, no electronic system, application, network or method of transmission can be guaranteed to be completely secure. If a data-security incident occurs, sewarth will take such steps as may be required under applicable law.

8. DATA RETENTION

Sewarth retains personal and healthcare information only for as long as reasonably necessary for the purposes for which it was collected, or for such period as may be required or permitted by applicable law, professional requirements, medical-record obligations, security requirements, dispute resolution or legitimate operational purposes.

Healthcare and consultation records may therefore continue to be retained after closure of an account where sewarth is legally required or otherwise lawfully permitted to retain them. The Ghar Aarogyam Program terms similarly provide that medical and consultation records may be retained for periods required by law, professional standards, regulatory requirements or applicable retention policies.

When information is no longer required and is not subject to a lawful retention requirement, it will be deleted, anonymised or securely disposed of in accordance with applicable procedures.

9. ACCOUNT AND DATA DELETION

If you have created an account with Ghar Aarogyam Program, you may request deletion of your account and associated personal information through the available deletion mechanism.

  • In-app: Settings → Account → Delete Account
  • Online deletion request / Email: gharaarogyam@gmail.com

Upon receiving a valid deletion request, sewarth will process the request in accordance with applicable law. Certain information may be retained where necessary to comply with legal, regulatory, medical-record, security, fraud-prevention or other lawful retention requirements.

10. YOUR PRIVACY RIGHTS

Subject to applicable law, you may have the right to request information regarding personal data processed by sewarth, seek correction of inaccurate or incomplete information, request deletion where legally permissible, withdraw consent where processing is based on consent, and raise a grievance concerning the processing of your personal information.

Withdrawal of consent may affect our ability to provide particular Ghar Aarogyam Program services where the relevant information is necessary for providing those services. Information that sewarth is legally required or otherwise lawfully permitted to retain may continue to be retained notwithstanding withdrawal or a deletion request.

11. MINORS

Where Ghar Aarogyam Program services are provided to a minor, appropriate consent and involvement of a parent or legally authorised guardian may be required. Sewarth may request verification of the authority of the person providing such consent and may restrict or decline a service where the required consent cannot be established.

12. EMERGENCY SERVICES

Ghar Aarogyam Program is not an emergency medical response service, ambulance service, emergency department or substitute for immediate in-person emergency care. Users experiencing a medical or psychological emergency should immediately seek appropriate emergency assistance or proceed to the nearest suitable hospital or emergency medical facility.

Where a serious and immediate safety concern arises during the use of Ghar Aarogyam Program, sewarth or a healthcare professional may take steps permitted or required by applicable law to protect the user or another person, including contacting an emergency contact, healthcare facility or appropriate emergency service.

13. THIRD-PARTY SERVICES

Ghar Aarogyam Program may use or integrate with third-party services for functions including payment processing, cloud hosting, communication, messaging, crm, technical support, security and other operational requirements. These providers may receive information reasonably necessary to perform their authorised functions. Where Ghar Aarogyam Program facilitates access to an independent third-party service, that third party may have its own terms and privacy practices, which may apply in addition to this privacy policy.

14. CHANGES TO THIS PRIVACY POLICY

Sewarth may update this privacy policy from time to time to reflect changes in the Ghar Aarogyam Program services, technology, data-processing practices or applicable legal requirements. The updated privacy policy will be made available through the app and/or the applicable website and will carry a revised effective date. Where applicable law requires fresh consent for a material change in processing, such consent will be obtained before relying on the changed processing for the relevant purpose.

15. GOVERNING LAW

This privacy policy shall be governed by the laws of India, subject to any mandatory rights, remedies or jurisdiction conferred by applicable law.
